Welcome to SensAI ("we," "us," "our," or "Company"). We provide an AI-powered personal training application (the "App") available on iOS, along with related services (collectively, the "Services"). Please read these Terms of Service ("Terms") carefully before using our Services.

By accessing or using the Services, creating an account, or otherwise indicating your assent, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.

1. Our Services

1.1 Description of Services

SensAI leverages artificial intelligence and your HealthKit data to offer personalized fitness and health-related recommendations, workout routines, and progress tracking. By integrating with Apple HealthKit, SensAI provides insights into your fitness activities and progress.

1.2 Not Medical Advice

SensAI is not a medical or healthcare provider and does not offer medical advice. Always consult a qualified healthcare professional before making any changes to your diet, exercise routine, or other lifestyle behaviors. Use of our Services is entirely at your own risk.

2. Eligibility

2.1 Age Requirement

You must be at least 16 years old (or the age of majority in your jurisdiction if higher) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

2.2 Compliance with Law

You agree to use the Services only as permitted by law. Any use of the Services in violation of applicable laws and regulations is strictly prohibited.

3. Account Registration and Security

3.1 Account Creation

Certain features of the Services may require you to create an account. You will do so through Sign in with Apple. We do not obtain your Apple ID password.

3.2 Accuracy of Information

You agree to provide and maintain accurate, current, and complete information about yourself. You are responsible for updating any relevant account information as necessary to keep it accurate.

3.3 Account Responsibility

You are solely responsible for the activities under your account, including maintaining the confidentiality of your login credentials. If you suspect any unauthorized use of your account, contact us immediately at support@sensai.fit.

4. Payment and Subscription (If Applicable)

4.1 Subscriptions

Some features of the Services may be offered on a subscription basis. Subscription fees, if any, will be clearly disclosed before you confirm your purchase. By subscribing, you authorize SensAI to charge the applicable fees via the payment method you provide.

4.2 Billing

We may use third-party payment processors to bill you for any fees. By submitting your payment information, you grant us the right to store and process your information with the payment processor.

4.3 Cancellation

You may cancel your subscription at any time. However, subscription fees paid are non-refundable to the fullest extent permitted by law.

5. Health and Safety Disclaimer

5.1 Consultation with Professionals

The recommendations provided through the Services are for informational and educational purposes only. Always consult a healthcare professional before beginning any exercise or nutrition program, especially if you have any medical condition or specific concerns.

5.2 Assumption of Risk

You acknowledge that exercise and fitness activities carry inherent risks. You agree to assume all risks in connection with your use of the Services and release SensAI from any liability arising from your use of or reliance on the Services.

6. User Conduct

6.1 Prohibited Activities

You agree not to:

• Use the Services for any fraudulent or unlawful purpose.
• Harass, threaten, intimidate, or defame any individual or entity.
• Access or attempt to access another user's account without permission.
• Reverse engineer, decompile, or otherwise attempt to obtain the source code of any part of the Services.
• Upload or transmit viruses or other harmful code.

6.2 Community Standards

If the Services include community or social features, you agree to follow any posted community guidelines and to refrain from posting unlawful, harmful, or objectionable content.

7. Ownership and Intellectual Property

7.1 Company Content

All content, trademarks, service marks, trade names, logos, and intellectual property rights in the Services ("Company IP") are the property of SensAI or its licensors. Except as provided in these Terms, you have no right, title, or interest in any Company IP.

7.2 License to Use

Subject to these Terms, SensAI grants you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes.

7.3 Feedback

By submitting feedback, ideas, or suggestions to SensAI, you agree that SensAI may use such feedback without any restriction or compensation to you.

8. Third-Party Services and Integrations

8.1 HealthKit

We integrate with Apple HealthKit to collect health and fitness data (e.g., steps, calories, activity metrics). You can manage your data permissions via your device settings. Please review our Privacy Policy for more details.

8.2 LLM Providers

• Summarized and Anonymized Data Only: We may share your data exclusively in summarized and anonymized form with third-party large language model (LLM) providers (e.g., OpenAI, Anthropic). This ensures no personally identifiable information is disclosed.
• Purpose: We share anonymized data only to generate personalized recommendations or insights that help us improve and tailor the Services.
• Data Handling: While we take measures to remove personal identifiers, we do not control how third parties handle data once shared. Refer to our Privacy Policy for more information about data protection and your rights.

8.3 External Links

The Services may contain links to third-party websites or services that are not under our control. We provide these links as a convenience and are not responsible for the content, privacy policies, or practices of third parties.

9. Termination and Suspension

9.1 Termination by You

You may delete your account or stop using the Services at any time.

9.2 Termination by SensAI

We reserve the right to suspend or terminate your account or access to the Services at our sole discretion, with or without notice, if you violate these Terms or for any other lawful reason.

9.3 Effect of Termination

Upon termination, your right to access the Services will cease immediately. Any provisions in these Terms that by their nature should survive termination will survive, including warranty disclaimers, indemnities, and liability limitations.

10. Disclaimers

10.1 As-Is

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SENSAI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that the Services will meet your requirements, or that they will be uninterrupted, secure, or error-free, or that results from using the Services will be accurate or reliable.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SENSAI AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL SENSAI'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID SENSAI (IF ANY) IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless SensAI and its affiliates, directors, officers, employees, and agents from all claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

13. Arbitration and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of laws principles.

13.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be settled by binding arbitration administered by the American Arbitration Association. By using the Services, you agree to waive your right to a trial by jury or to participate in a class action lawsuit.

13.3 Venue

For any claims not subject to arbitration, you agree that the exclusive jurisdiction for such claims shall be the state or federal courts located in Delaware, and you waive any objection to such jurisdiction or venue.

14. Changes to the Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with notice (e.g., by email or through the Services). By continuing to access or use the Services after such changes become effective, you agree to be bound by the revised Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SensAI regarding the Services.

15.2 Waiver and Severability

The failure of SensAI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may freely assign or transfer these Terms at our discretion.
